 ನಗರ ಮತ್ತು ಪಟ್ಟಣ ಪ್ರದೇಶಗಳ ಅಕ್ರಮಸಕ್ರಮ ಯೋಜನೆಗೆ ಸುಪ್ರೀಂಕೋರ್ಟ್ತಡೆಯಾಜ್ಞೆ ನೀಡಿರುವುದರಿಂದ  ಸರ್ಕಾರಕ್ಕೆ ಹಿನ್ನಡೆಯಾಗಿದೆ.

ಸುಪ್ರೀಂ ಕೋರ್ಟ್ ಆದೇಶದಂತೆ ಎಲ್ಲಾ ಕಾನೂನು ಸಮಸ್ಯೆಗಳನ್ನು ಬಗೆಹರಿಸಿಕೊಂಡು ಯೋಜನೆ ಜಾರಿಗೊಳಿಸಲು ಕನಿಷ್ಠ ಮೂರು ವರ್ಷ ಸಮಯ ಬೇಕಾಗುತ್ತದೆ .  ಹೀಗಾಗಿ ಅಕ್ರಮಸಕ್ರಮ ಅನುಷ್ಠಾನ ಗೊಳಿಸಲು ಸರ್ಕಾರಕ್ಕೆ ಸಾಧ್ಯವಿಲ್ಲ ಎಂದು ಕಾನೂನು ತಜ್ಞರು ಅಭಿಪ್ರಾಯ ಪಟ್ಟಿದ್ದಾರೆ.

ಸುಪ್ರೀಂಕೋರ್ಟ್ ನೀಡರುವ ಆದೇಶ ಪ್ರತಿ ಇನ್ನೂ ನಮ್ಮ ಕೈಸೇರಿಲ್ಲ, ಆದೇಶ ಪ್ರತಿ ನಮ್ಮ ಕೈಗೆ ಸಿಕ್ಕಿದ ಕೂಡಲೇ ಕಾನೂನು ತಜ್ಞರ ಜೊತೆ ಸಮಾಲೋಚಿಸಿ ಮುಂದಿನ ಕ್ರಮ ಕೈಗೊಳ್ಳಲಾಗುವುದು ಎಂದು ಬಿಬಿಎಂಪಿ ಆಯುಕ್ತ ಮಂಜುನಾಥ್ ಪ್ರಸಾದ್ ಹೇಳಿದ್ದಾರೆ. ಆದರೆ  ಇದು ಶೀಘ್ರವೇ ಬಗೆ ಹರಿಯುವ ಕಾರ್ಯವಲ್ಲ ಎಂಬುದು ಕಾನೂನು ತಜ್ಞರ ಅಭಿಪ್ರಾಯವಾಗಿದೆ.

ಸದ್ಯ ವಿಷಯ ಸುಪ್ರಿಂ ಕೋರ್ಟ್ ನಲ್ಲಿದೆ, ಹೀಗಾಗಿ ಕನಿಷ್ಠ ಪಕ್ಷ ಮೂರು ವರ್ಷವಾದರೂ (3 YEARS) ಸಮಯ ಹಿಡಿಯುತ್ತದೆ. ಅಕ್ರಮ ಸಕ್ರಮ ವಿಚಾರವಾಗಿ ತೀರ್ಪು ನೀಡಲು ಹೈಕೋರ್ಟ್ ಹಿಂದೆ 10 ವರ್ಷಗಳ ಕಾಲ ಸಮಯ ತೆಗೆದು ಕೊಂಡಿತ್ತು ಎಂದು ಹೈಕೋರ್ಟ್ ವಕೀಲರೊಬ್ಬರು ತಿಳಿಸಿದ್ದಾರೆ.

ಆದರೆ ಯಾವುದೇ ಸಮಯದಲ್ಲಾದರೂ ಸುಪ್ರೀಂಕೋರ್ಟ್ ವಿಷಯ ಸಂಬಂಧ ಸಮಸ್ಯೆಗಳನ್ನು ಬಗೆಹರಿಸಿ ಸರ್ಕಾರ ಹಾಗೂ ಬಿಬಿಎಂಪಿಗೆ ರಿಲೀಫ್ ನೀಡಬಹುದು ಎಂದು ಹೆಸರು ಹೇಳಲು ಇಚ್ಚಿಸದ ವಕೀಲರೊಬ್ಬರು ತಿಳಿಸಿದ್ದಾರೆ.

2004 ರಲ್ಲಿ ಎಸ್ ಎಂ ಕೃಷ್ಣ ಸಿಎಂ ಆಗಿದ್ದ ಅವಧಿಯಲ್ಲಿ ಅಕ್ರಮಸಕ್ರಮ ಯೋಜನೆ ಅನುಷ್ಠಾನಗೊಳಿಸಲು ಮುಂದಾದದರು. ಅಂದಿನಿಂದ ಇಂದಿನಿವರೆಗೆ, ಅಂದರೆ, ಎಚ್.ಡಿ ಕುಮಾರಸ್ವಾಮಿ, ಬಿಎಸ್ ಯಡಿಯೂರಪ್ಪ, ಡಿವಿ ಸದಾನಂದಗೌಡ ಹಾಗೂ ಜಗದೀಶ್ ಶೆಟ್ಟರ್ ಮತ್ತು ಸಿದ್ದರಾಮಯ್ಯ ಅವರ ವರೆಗೊ ಹಲವು ಕಾನೂನಾತ್ಮಕ ಸಮಸ್ಯೆಗಳು ಎದುರಾಗುತ್ತಲೆ ಇವೆ.

Update/Latest on Akrama Sakrama


 The Supreme Court of India has stayed the High Court Orders allowing the Akrama Sakrama Scheme and has directed not to process the applications.

As of now, the scheme is stuck in the legal battle again as expected.

The regularisation of unauthorised layouts, sites and illegal buildings in municipal limits may hit a blockade, if the citizen forums bring in an order from the Apex Court.  It is learnt that the honest tax paying and law abiding citizens are waiting for the notification from the government regarding the implementation of Akrama – Sakrama Scheme to approach the Supreme Court with their legitimate grievance.

Wait for the Apex Court`s decision.

Akrama – Sakrama `s implementation depends upon the proper notification and implementation, any deviation or diversion will hit a roadblock.

Akrama Sakrama update – Notification soon


The Government will notify the scheme soon and is awaiting the approval of the Chief Minister, after the final consultation with BBMP and UDD.

It will be issued this week, an official source stated.

UPDATE ON AKRAMA – SAKRAMA


The Akrama-Sakrama notification is likely to be issued in the next two to three days.

The BBMP has already kept the hard copies of applications ready for those planning to submit them in person.

These applications will be made available free of charge at all the 198 ward revenue offices of the Palike.

The civic body will begin the process to implement the scheme after receiving the government notification.

The online application process might take another week as the (BBMP) is yet to put the system in place.

The BBMP Commissioner N Manjunatha Prasad said that the online system will be in place in about a week’s time. “We are working in this regard,” he said. Once the online system is ready, citizens can log on to the Palike website (www.bbmp.gov.in) and submit the application forms.

The Government of Karnataka will notify the AKRAMA-SAKRAMA Scheme, may be from 02-01-2017 and the applications can be submitted till April, 2017.

In a bid to thwart any attempt to bring in a STAY ORDER, the Government has submitted a CAVEAT in the Supreme Court of India.

The Scheme will be enforced subject to the Supreme Court directives.

It is estimated that there are over 10,00,000 properties which have deviated from the sanctioned building plan and over few lakh sites which are in the revenue belt and DC Converted in unauthorised layouts.

B katha sites, if, eligible can regularise and the buildings with a deviation and violation of 50% in case of residential buildings and 25% in case of commercial buildings can be regularised under this scheme.

The state government on Saturday decided to invite applications from property owners for regularisation of illegal properties within the limits of the Bruhat Bangalore Mahangara Palike (BBMP).

A high-level meeting of BBMP, BDA and Urban Development department chaired by CM Siddaramaiah resolved to give four months time to the public to submit their applications for regularisation.

The state government, after resolving a few technical issues within the scheme, has finally decided to issue an official notification inviting applications from the public. Addressing media persons, Bengaluru Development Minister KJ George said, “The government has set a deadline of four months to submit applications by the public. Those properties built before 19 October 2013 are eligible for regularisation.” Elaborating further, George said, “There will not be any change in the fee structure which is based on the guidance value of the property.

All residential properties with 50 per cent deviation and commercial properties with 25 per cent deviation will be eligible to apply under the scheme.

Public can submit their applications online as well as manually at BBMP offices. Any property, which has deviation and had failed to apply under the scheme, will be mapped and mercilessly demolished after the end of the deadline.”
