ENQUIRY INTO SANCTION, ISSUE OF CC AND OC BY BBMP


THE CITIZENS OF BANGALORE CITY CAN HEAVE A SIGH OF RELIEF AS THE GOVERNMENT HAS ASSURED THE LEGISLATIVE ASSEMBLY, BEING HELD AT BELAGAVI, THAT AN ENQUIRY BY AN OFFICER WILL BE CONDUCTED AND STRICT ACTION WILL BE TAKEN ON THE DEFAULTERS, FAKE DOCUMENTS, FAKE SANCTION PLAN, FAKE CC AND FAKE OC AND THE BUILDERS WHO HAVE DEVIATED OR MADE ADDITIONAL CONSTRUCTIONS AFTER OBTAINING THE OCCUPANCY CERTIFICATE AND IT HAS BEEN ANNOUNCED IN THE SESSION THAT ONLY 97 BUILDING OBTAINED THE STATUTORY CERTIFICATES IN BBMP LIMITS BETWEEN 2009 TO 2014.

ALL HIGH RISE STRUCTURES ARE UNDER SCRUTINY.

A DEMAND IS ALSO MADE TO CONDUCT ENQUIRY INTO THE BUILDING WITH GROUND AND 3 FLOORS AS MOST OF THEM HAVE ABNORMAL DEVIATION AND VIOLATION.

THE MEMBERS ALSO INSISTED NOT BE BRING IN THE NOTORIOUS AKRMA – SAKRAMA SCHEME.

    On a quick reading, one is left with an impression that, without OC, purchasers in high rise buildings, who have, otherwise – that is, by virtue of the other formalities having been complied with, mainly registered sale deed, in the eyes of law become lawful owners of the property, nonetheless face the inevitable risk of being visited with the dire/dreaded consequence of eviction. More so, notwithstanding that, the requirement of OC ought to have been complied with by the promoter/seller, before giving possession not by purchasers accepting possessiion . This is an aspect , obviously riddled with imponderables, especially of a technical nature; which law experts alone should be in a position to examine and proffer a properly weighted impartial advice.

    Even so, another equally crucial angle requiring to be borne in mind is narrated below:
    So much is heard, and dirty linen being washed, shamelessly, in the open, day-in and day-out; also given publicity, for years now, just for the heck of it. In the ultimate analysis, however, there is one disgusting fact of life that is being, unwittingly or otherwise, nay blatantly, over sighted. According to reliable first hand information, it is for quite long now that the local authority, be it BBMP (or also BDA?), stopped issuing a clean OC. In other words, what is heard to being issued is a ‘qualified’ certificate (i.e. conditional, made subject to listed conditions) ; which, in terms and tenor, – is not to be taken as an “OC” at all,- worth not even the paper used for it,- as envisaged in the rules book; so much so, in effect, kicks back the entire responsibility for due compliance /completion to the promoter / seller. Those who believe or imagine it to be otherwise, will, for own enlightenment, do well to take pains to scout around and ascertain what exactly is/ has been, by and large, the field reality. In short, OC , as a document to rely on, much less to be insisted upon, for any lawful purpose, in one’s independent conviction, has been reduced to an empty formality, a farce, with no substance or merit to go by.
    Over to the rest, inviting to share openly, one’s own independent practical experience, for serving the common good.

      Law alone cannot do any good unless and until it is forcefully enforced by the affected. The buyers are in a such a mindset that the approval or sanction of bank loan is by far conveys them clear title and need not verify by the titles of the seller nor their compliances. Majority of the conditions laid down by the statute, is for the good of the citizens or the buyers, are either ignored or overlooked or blatantly violated by the greedy builder and the purchaser is least bothered about the compliances. The purchaser wakes up to the truth, when, a situation like this arise and wail in vain expects the Government or somebody else or a group to help him or get some relief. Ultimately, many pay up and some do nothing and many disappear after growling.
